Provider / Operator: Panama Travel Co. (Tyul) (“Panama Travel Co.”)
Trip Name: Tafsik trip to Panama
1) Parties; Scope of Coverage
This Waiver, Release of Liability, Assumption of Risk, Indemnity, and Cancellation Policy (the “Agreement”) is entered into by the undersigned participant (“Participant”) in connection with the trip to Panama (the “Trip”). The Trip is organized for Tafsik (the “Organization”) and coordinated/operated by Panama Travel Co. (Tyul) (“Panama Travel Co.”).
This Agreement applies to the entire Trip, including but not limited to: airport transfers, ground transportation, lodging, excursions, guided activities, ferries/boats, meals, and any other services arranged, recommended, or facilitated by Panama Travel Co. and/or the Organization, whether delivered directly or through third-party suppliers.
2) Acknowledgment of Inherent Risks; Assumption of Risk
Participant understands and voluntarily assumes all risks associated with international travel and participation in Trip activities, whether foreseeable or unforeseeable. Risks include, without limitation:
Transportation risks: vehicle travel, traffic incidents, ferry/boat transit, delays, mechanical failures, and related hazards.
Outdoor/adventure risks: hiking on uneven or slippery terrain, waterfalls, heat/humidity, physical exertion, remote conditions, and limited access to immediate medical care.
ATV and similar activities: collisions, rollovers, operator error, equipment failure, and serious injury.
Water-related risks: boating, ferries, swimming, currents, drowning, and weather changes.
Animals and nature: interaction with wildlife, insects, bites/stings, and unpredictable animal behavior.
General travel risks: illness, food-related reactions, theft, crime, civil disturbance, and acts of other travelers.
Participant represents they are physically and mentally able to participate in the Trip and will exercise care and good judgment at all times.
3) Third-Party Operators; No Control Over Suppliers
Participants acknowledge that many Trip services (including transportation, boats/ferries, activity operators, and certain venues) are provided by independent third-party suppliers not under the direct control of Panama Travel Co. or the Organization. While Panama Travel Co. coordinates bookings and logistics, Participant agrees that the Released Parties (defined below) are not liable for the acts or omissions of third-party suppliers, including their negligence, delays, cancellations, service interruptions, equipment issues, or safety practices, except to the extent non-waivable by law.
4) Free Time / Participant Responsibility
Participant acknowledges the Trip may include periods of free time where Participant is not under supervision. During free time, Participant is solely responsible for their actions, choices, location, spending, and safety, including any activities they choose to undertake independently (whether or not suggested by others).
5) Release of Liability (Including Negligence Where Permitted)
To the maximum extent permitted by applicable law, Participant releases and forever discharges:
Panama Travel Co. (Tyul) and its owners, directors, officers, employees, contractors, guides, agents, affiliates, and representatives;
the Organization and its officers, employees, volunteers, and representatives;
(collectively, the “Released Parties”)
from any and all claims, demands, causes of action, damages, losses, liabilities, or expenses of any kind arising out of or relating to the Trip, including personal injury, illness, death, property loss, theft, or other damages, whether arising from negligence or otherwise, except to the extent such release is prohibited by law or involves gross negligence or willful misconduct.
6) Indemnity / Hold Harmless
Participant agrees to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) Participant’s conduct during the Trip; (b) Participant’s breach of this Agreement; or (c) Participant’s participation in any activity during the Trip.
7) Medical Insurance; Medical Costs; Emergency Care Authorization
Medical insurance is not included in the Trip price. Participant is strongly encouraged to purchase travel medical insurance (including emergency evacuation coverage). If Participant would like to add insurance through Panama Travel Co. (if available), Participant may request a quote during registration.
Participant agrees they are financially responsible for any medical, hospital, medication, evacuation, transportation, or related costs incurred during the Trip that are not covered by insurance.
In case of illness or injury, Participant authorizes Panama Travel Co. and/or the Organization to obtain or arrange emergency medical care and transportation for Participant if Participant is unable to do so. Participant releases the Released Parties from liability relating to decisions made in good faith to secure emergency assistance, to the extent permitted by law.
8) Allergies, Medical Disclosures, Dietary Needs; Limitation of Liability
Participant acknowledges that the registration form requests information such as allergies, dietary restrictions, and relevant medical considerations. Participant agrees:
Participant is responsible for accurately and completely disclosing allergies/medical needs during registration and updating the Organization/Panama Travel Co. if anything changes.
If Participant fails to disclose an allergy/medical condition, Participant assumes all resulting risk and releases the Released Parties from liability to the extent permitted by law.
Even if disclosed, Participant acknowledges there is always risk of inadvertent exposure, cross-contact, labeling errors, supplier mistakes, or misunderstandings by third parties. Participant agrees that the Released Parties are not responsible for third-party errors or unavoidable cross-contact, and that the Released Parties’ role is limited to reasonable coordination and communication.
Important: Nothing in this section limits liability for gross negligence or willful misconduct where such limitation is not permitted.
9) Rules, Safety Instructions, and Removal
Participant agrees to follow Trip rules, safety briefings, guide instructions, and local laws. Participant acknowledges that Panama Travel Co. and/or the Organization may restrict or deny participation in any activity if safety concerns arise. Participant may be removed from an activity or from the Trip (without refund) if Participant’s behavior creates risk, disrupts the group, or violates laws or program rules.
10) Force Majeure; Changes for Safety
The Released Parties are not responsible for events beyond their reasonable control (including weather, natural disasters, government actions, health emergencies, road closures, civil disturbances, supplier failures, or security issues). The itinerary may be modified, substituted, rescheduled, or canceled for safety or operational reasons, and Participant agrees such changes do not create liability for the Released Parties.
11) Media Release (Social Media and Marketing)
Participant grants Panama Travel Co. and the Organization permission to photograph, film, or record Participant during the Trip and to use Participant’s image/likeness/voice in Trip documentation and marketing (including social media, website, promotional materials) without compensation.
12) WhatsApp Group and Communications Consent
Participant consents to receiving Trip-related communications by email, phone, and WhatsApp. Participant acknowledges that operational WhatsApp groups may display Participant’s name and phone number to other participants, and Participant agrees to participate respectfully.
13) Cancellation Policy; Refund Schedule; Name Changes
Participant acknowledges that the Provider must secure accommodations and certain activities in advance. For that reason:
A. Non-Refundable Amount (Administrative + Pre-Booked Components)
A fixed amount of USD $350 per participant is non-refundable under all circumstances once the booking is confirmed. This amount covers administrative processing and non-refundable or pre-paid components, including accommodations and certain activities that require advance reservations.
B. Refundable Portion and Timeline (Remaining Balance After the $350)
All refunds below are calculated only on the amount paid minus the non-refundable $350 (the “Refundable Portion”):
Cancel 30 days or more before the Trip start date: 100% of the Refundable Portion is refundable.
Cancel 15–29 days before the Trip start date: 50% of the Refundable Portion is refundable.
Cancel 8–14 days before the Trip start date: 25% of the Refundable Portion is refundable.
Cancel 0–7 days before the Trip start date (or no-show): 0% of the Refundable Portion is refundable.
C. Unused Services / Missed Activities
No refunds or credits will be issued for any unused services or missed activities due to late arrival, early departure, flight changes, illness, choosing not to participate, removal for misconduct or safety reasons, or any other reason outside the Provider’s control.
D. How to Cancel
Cancellations must be submitted in writing to the Provider at reservations@panamatravelco.com and/or +507 6609-6870. The cancellation “received date” is the timestamp when written notice is received.
E. Name Changes / Substitutions
Name changes and substitutions are accepted, subject to supplier rules. Participant (or the participant’s sponsoring group, if applicable) is responsible for any supplier-imposed change fees and for ensuring the substitute participant meets eligibility requirements (passport validity, waivers, etc.).
F. Non-Refundable Supplier Charges
Participant acknowledges certain supplier charges may be non-refundable or partially refundable regardless of the schedule above. Where supplier terms impose stricter non-refundability, refunds will be limited to what is recoverable from suppliers.
G. Processing Time and Payment Method
Approved refunds will be processed to the original payment method where possible, less any non-refundable amounts and any non-recoverable payment processing fees (e.g., credit card fees), to the extent permitted by law.
14) Governing Law; Venue; Language
This Agreement is governed by the laws of the Republic of Panama, without regard to conflict of laws principles. Any dispute arising from or relating to this Agreement or the Trip shall be brought exclusively in the competent courts located in Panama City, Panama. The parties agree that English is the controlling language of this Agreement.
15) Severability; Entire Agreement
If any provision is found unenforceable, the remaining provisions remain in full force and effect. This Agreement is the entire agreement on risk allocation, liability, and cancellation related to the Trip and supersedes prior statements on these topics.
By signing, Participant confirms they have read, understood, and voluntarily agree to this Agreement.
