This waiver must be signed (or electronically accepted) before participating in any Panama Travel Co. (Tiyul S.A.) tours, activities, or services. By booking or signing electronically, you confirm that you have read, understood, and agreed to the Terms, Conditions, and Liability Waiver below.
“Panama Travel Co.” / “Tiyul S.A.” / “Company” means the legal entity providing tours, activities, and related services.
“Client” / “Participant” means the person booking or participating in any tour or service.
“Services” include tours, accommodations, transportation, meals, activities, and all related arrangements offered by the Company.
By booking or participating in any service, the Client accepts these Terms on their own behalf and, where applicable, on behalf of minors or others included in the booking.
Reservations are only confirmed once full payment (or a deposit, where offered) has been received.
The Company reserves the right to decline a booking at its sole discretion.
All prices are in U.S. Dollars unless stated otherwise.
Prices are subject to change prior to full payment.
Quoted prices include only the items specified in the itinerary. Additional expenses are the Client’s responsibility.
Payment: Full payment is required before participation unless otherwise agreed in writing.
Client cancellations
No-shows or late arrivals: non-refundable.
14 days or less: non-refundable.
15–29 days before the tour: 50% refund.
30+ days before the tour: full refund
Company cancellations:
Panama Travel Co. may cancel or modify services due to weather, safety, operational concerns, or force majeure.
In such cases, Clients may reschedule (subject to availability) or receive a refund limited to the amount paid for the tour.
The Company is not responsible for additional expenses such as flights or hotels not booked through us.
The Company is not liable for failure to perform obligations due to events beyond its reasonable control, including natural disasters, strikes, pandemics, or government restrictions.
Clients must disclose medical conditions, allergies, disabilities, or dietary needs at the time of booking.
The Company may refuse participation if safety is compromised.
The Company strongly recommends that all Clients purchase medical, accident, and travel insurance. Panama Travel Co. does not provide such coverage.
Clients consent to the use of photos, videos, or recordings taken during tours for promotional purposes unless a written objection is provided in advance.
The Company collects and uses Client information solely for booking and operational purposes and will not sell personal data to third parties.
Clients are encouraged to raise concerns promptly during the trip. If unresolved, complaints must be submitted in writing within 10 days of the tour. Disputes shall be resolved under the laws of the Republic of Panama.
These Terms shall be governed exclusively by the laws of the Republic of Panama. Courts in Panama City shall have jurisdiction.
If any provision of these Terms is deemed unenforceable, the remainder shall remain valid and enforceable.

Assumed Risks
I UNDERSTAND THAT TOURS AND ACTIVITIES OFFERED BY PANAMA TRAVEL CO. (INCLUDING HIKING, CANOPY, AQUATIC NAVIGATION, LAND TRANSPORTATION, AND OTHER EXPERIENCES) CARRY INHERENT RISKS SUCH AS INJURY, ILLNESS, ACCIDENTS, PROPERTY DAMAGE, OR EVEN DEATH. I VOLUNTARILY ACCEPT ALL SUCH RISKS.
Release of Liability
On behalf of myself, my heirs, legal representatives, and family members, I RELEASE PANAMA TRAVEL CO. / TIYUL S.A., ITS EMPLOYEES, AGENTS, AFFILIATES, AND CONTRACTORS FROM ANY LIABILITY FOR DAMAGES ARISING DIRECTLY OR INDIRECTLY FROM MY PARTICIPATION.
Jurisdiction
I agree that any legal dispute related to this waiver shall be resolved exclusively under the laws of the Republic of Panama. I understand that Panama Travel Co. may invoke this release in legal proceedings in the United States or elsewhere.
Physical Condition
I confirm that I am physically and mentally fit to participate. I have not been advised otherwise by a medical professional.
Travel Insurance
I understand that Panama Travel Co. does not provide medical, accident, or travel insurance. I am solely responsible for obtaining such coverage if desired.
Minors
If signing as the responsible adult for a minor, I accept all the above terms on their behalf.
Electronic Signature
I understand that this waiver may be signed digitally and is legally binding as a handwritten signature.
Riesgos asumidos
RECONOZCO QUE LOS TOURS Y ACTIVIDADES OFRECIDOS POR PANAMA TRAVEL CO. (INCLUYENDO SENDERISMO, CANOPY, NAVEGACIÓN, TRANSPORTE TERRESTRE Y OTRAS EXPERIENCIAS) IMPLICAN RIESGOS INHERENTES COMO LESIONES, ENFERMEDADES, ACCIDENTES, DAÑOS A LA PROPIEDAD O INCLUSO LA MUERTE. ASUMO VOLUNTARIAMENTE TODOS ESOS RIESGOS.
Liberación de responsabilidad
EN MI NOMBRE Y EN NOMBRE DE MIS HEREDEROS, REPRESENTANTES LEGALES Y FAMILIARES, LIBERO A PANAMA TRAVEL CO. / TIYUL S.A., SUS EMPLEADOS, AGENTES, AFILIADOS Y CONTRATISTAS DE TODA RESPONSABILIDAD POR DAÑOS DERIVADOS DIRECTA O INDIRECTAMENTE DE MI PARTICIPACIÓN.
Jurisdicción
ACEPTO QUE CUALQUIER DISPUTA RELACIONADA CON ESTA EXONERACIÓN SERÁ RESUELTA EXCLUSIVAMENTE BAJO LAS LEYES DE LA REPÚBLICA DE PANAMÁ. RECONOZCO QUE PANAMA TRAVEL CO. PODRÁ INCLUIR ESTA EXONERACIÓN COMO DEFENSA EN PROCEDIMIENTOS LEGALES EN ESTADOS UNIDOS U OTRA JURISDICCIÓN.

DECLARO ESTAR EN CONDICIONES FÍSICAS Y MENTALES APTAS PARA PARTICIPAR.
Seguro de viaje
ENTIENDO QUE PANAMA TRAVEL CO. NO PROPORCIONA SEGURO MÉDICO, DE ACCIDENTES NI DE VIAJE. ASUMO LA RESPONSABILIDAD DE CONTRATAR UNO SI LO DESEO.
Menores de edad
SI FIRMO COMO ADULTO RESPONSABLE DE UN MENOR, ACEPTO TODOS LOS TÉRMINOS ANTERIORES EN SU NOMBRE.
Aceptación electrónica
ENTIENDO QUE ESTA EXONERACIÓN PUEDE FIRMARSE ELECTRÓNICAMENTE Y TENDRÁ LA MISMA VALIDEZ QUE UNA FIRMA MANUSCRITA.
